Governed under the laws of Alberta, Canada. These policies apply to all residential, commercial, and emergency drain cleaning calls dispatched by MainDrain.
1. AUTHORIZATION TO PERFORM WORK
I authorize MainDrain, including its employees, technicians, contractors and subcontractors, to enter the premises and perform the plumbing, drain cleaning, sewer, excavation, repair, inspection, maintenance or other work authorized by me.
Services may include, but are not limited to:
Drain cleaning and blockage removal
Sewer cleaning and repair
Camera inspections
Hydro jetting
Plumbing repairs
Fixture installation or repair
Sewer and water-line replacement
Excavation and trenching
Root removal
Pipe repair or replacement
Emergency plumbing and sewer services
Related access, removal and restoration work.
2. EXISTING AND HIDDEN CONDITIONS
I understand that existing plumbing, sewer lines and underground systems may contain defects or conditions that cannot be seen before work begins.
These may include:
Cracked, broken, collapsed or deteriorated pipes
Corrosion or scale
Root intrusion
Offset or separated joints
Improper previous repairs
Improper installation
Hidden leaks
Bellied or sagging sewer lines
Unknown underground utilities
Other concealed conditions.
I understand that working on an existing system may expose or cause an existing weak or damaged component to fail.
MainDrain is not responsible for damage or failure caused by a pre-existing or concealed condition that MainDrain did not cause, except where liability cannot legally be excluded.
3. DRAIN CLEANING
I understand that drain cleaning is intended to restore or improve flow but may not permanently correct the underlying cause of a blockage.
Blockages may return because of roots, grease, foreign objects, pipe deterioration, scale, structural defects, improper installation or other conditions.
Unless MainDrain provides a specific written guarantee, drain cleaning does not guarantee that a drain or sewer will remain clear for any particular period of time.
4. MECHANICAL CABLES AND HYDRO JETTING
I understand that mechanical drain-cleaning equipment and high-pressure hydro jetting can place force on existing piping.
If piping is old, damaged, deteriorated, cracked, corroded or otherwise structurally compromised, cleaning may expose an existing weakness or cause the pipe to fail.
I authorize MainDrain to use appropriate drain-cleaning equipment to perform the authorized work.
MainDrain is not responsible for failure of existing piping caused by its pre-existing condition, except where liability cannot legally be excluded.
5. CAMERA INSPECTIONS
I understand that a sewer camera inspection can only inspect portions of the system that the camera can access.
A camera may not be able to pass through severe blockages, collapsed pipes, offsets or other obstructions.
A camera inspection is therefore not a guarantee that the entire plumbing or sewer system is free of defects.
6. EXCAVATION AND UNDERGROUND WORK
I understand that excavation and underground work involve risks, including encountering unknown or incorrectly located utilities and structures.
These may include:
Gas lines
Electrical lines
Water lines
Sewer lines
Telecommunications
Irrigation systems
Sprinkler systems
Private utilities
Landscaping
Concrete or asphalt
Foundations
Other buried structures or improvements.
I agree to provide MainDrain with any information I have regarding underground utilities, previous repairs and buried infrastructure.
I understand that some private utilities may not be identified through standard utility-locating services.
MainDrain is not responsible for damage to undisclosed private utilities or underground infrastructure except where liability cannot legally be excluded.
7. ACCESS TO PROPERTY
I authorize MainDrain to access areas reasonably necessary to perform the work.
Access may require cutting, drilling, removing or disturbing:
Drywall
Flooring
Concrete
Asphalt
Cabinets
Landscaping
Sod
Decking
Walls
Ceilings
Other finishes or structures.
Unless specifically included in the written scope of work, repair or replacement of removed or damaged finishes is not included in the price.
8. EMERGENCY WORK
For emergency calls, I authorize MainDrain to take reasonable steps to locate, access, isolate or mitigate the problem.
This may include shutting off water, exposing piping, removing materials or performing temporary repairs.
Emergency work may reveal additional repairs that were not known when the service call began.
9. WATER, SEWAGE AND PROPERTY DAMAGE
I understand that plumbing and sewer failures can cause water, sewage or other property damage.
MainDrain is not responsible for damage that existed before MainDrain arrived or for damage caused by conditions that MainDrain did not create.
The Customer is responsible for promptly informing MainDrain of known leaks, flooding, sewage backups, contamination, structural problems or other hazards.
10. CUSTOMER RESPONSIBILITIES
I agree to:
Provide accurate information about the property and plumbing system.
Disclose known underground utilities and hazards.
Provide reasonable access to the work area.
Keep children, pets and unauthorized persons away from the work area.
Disclose known previous plumbing, sewer or excavation work.
Obtain any approvals that are my responsibility.
Notify MainDrain promptly if I have concerns about the work.
11. HAZARDOUS OR UNSAFE CONDITIONS
I agree to disclose any known hazardous materials or unsafe conditions.
These may include asbestos, mould, sewage contamination, chemicals, gas, electrical hazards, unstable structures or contaminated soil.
MainDrain may stop or refuse work where conditions are unsafe or require specialized services.
Additional costs resulting from undisclosed hazardous conditions may be charged to the Customer where permitted by law.
12. ESTIMATES AND ADDITIONAL WORK
I understand that estimates are based on conditions reasonably known or visible when the estimate is prepared.
Hidden or unforeseen conditions may require additional work.
Where reasonably possible, MainDrain will obtain my approval before performing additional chargeable work.
In an emergency, MainDrain may take reasonable action without prior written approval when delay could increase damage, risk or cost.
I agree to pay for additional work that I authorize.
13. ASSUMPTION OF RISK
I understand that working on existing plumbing, sewer systems and underground infrastructure involves risks that cannot always be identified beforehand.
These risks may include:
Discovery of hidden defects
Failure of deteriorated piping
Additional required repairs
Temporary interruption of plumbing service
Damage to finishes required to access concealed infrastructure
Damage or failure caused by existing conditions.
To the fullest extent permitted by law, I accept these ordinary risks associated with the authorized work.
14. LIMITED RELEASE
To the fullest extent permitted by law, I release and hold harmless MainDrain and its owners, employees, technicians, contractors and subcontractors from claims or losses resulting from:
Pre-existing conditions
Concealed defects
Deteriorated or defective existing plumbing
Undisclosed private utilities
Inaccurate information provided by the Customer
Conditions that could not reasonably have been discovered before or during the work
Consequential or indirect losses not caused by MainDrain.
This release does not apply to liability caused by MainDrain’s negligence, wilful misconduct, breach of contract, or any other liability that cannot legally be excluded or limited.
15. WARRANTIES
Any warranty provided by MainDrain will be limited to the specific work and materials identified in the applicable written warranty.
Unless specifically stated in writing, MainDrain does not guarantee:
That an existing drain or sewer will remain clear
That an existing pipe will not fail

That a repair will correct unrelated or underlying problems
That underground conditions will remain unchanged.
Manufacturer warranties may apply separately to products supplied by MainDrain.
16. CUSTOMER-SUPPLIED MATERIALS
If I provide materials, fixtures or equipment, MainDrain is not responsible for defects, incompatibility or manufacturer failures relating to those items.
MainDrain may refuse to install materials that are unsafe, defective or unsuitable for the intended application.
17. PAYMENT
I agree to pay MainDrain for all authorized labour, materials, equipment, disposal, applicable taxes and other charges included in the estimate, work order or invoice.
Additional authorized work will be charged accordingly.
18. PHOTOS AND VIDEO
I authorize MainDrain to take photographs, video and sewer-camera footage of the work and property for purposes including:
Diagnosis
Documentation
Estimates
Warranty records
Insurance
Dispute resolution
Business records.
MainDrain will handle personal information in accordance with applicable privacy laws.
19. NO WAIVER OF LEGAL RIGHTS
Nothing in this Agreement is intended to waive or remove any right or protection that cannot legally be waived.
If any part of this Agreement is found to be unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.
20. GOVERNING LAW
